Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Brightfield Technologies Inc., a Delaware corporation doing business as “Qolour” with its principal place of business in Pasadena, Maryland (“Qolour,” “we,” “us,” or “our”).

By placing a preorder, creating an account, or using qolour.io (the “Site”), you agree to these Terms and to our Privacy Policy. If you do not agree, please do not place an order or use the Site.

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. If you are buying on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Payment. Full payment is required at the time of preorder. By placing a preorder, you authorize Qolour to charge your payment method for the total order amount.

Estimated delivery. Preorders are expected to ship in July 2026. You will receive an email notification 14 days before your order ships with tracking information.

Production delays. While we aim to meet our estimated delivery timeline, manufacturing delays can happen. We will communicate any change to the shipping schedule by email as soon as we know about it. If a delay would push delivery beyond the originally disclosed shipping window, you may cancel the preorder for a full refund under §4.

Product changes. Qolour may make minor changes to the Qubi's design, packaging, software, or included accessories before delivery, provided those changes do not materially reduce the product's core functionality. If we make a material change before shipment, we will notify you and give you the option to cancel for a full refund.

Product units. Qubi is sold exclusively in pairs. Each preorder includes two (2) Qubi units.

Order limits. No minimum or maximum quantity restrictions.

You may cancel your preorder and receive a full refund by contacting info@qolour.io until one (1) week before your order ships.

Once we send the 14-day shipping notification, you have up to 7 days from that notification to request cancellation. After this window closes, the preorder is final and non-refundable, subject to your post-delivery return rights in §6.

Approved refunds are processed to your original payment method within 5–10 business days.

Prices are listed in US dollars unless otherwise stated. We may change prices at any time, but changes don't affect orders already placed.

Payment processing. Payments are processed by Stripe, Inc. By placing an order, you agree to Stripe's terms as well as these Terms.

Sales tax. Applicable sales tax is calculated and charged at checkout based on your shipping address. Tax-exempt institutional buyers (federal labs, registered nonprofits, etc.) may request a tax-exempt order by contacting orders@qolour.io with a copy of their exemption certificate before placing the order.

Discount and promotional codes. Discount codes apply only to qualifying orders, cannot be combined unless stated, and may be terminated by Qolour at any time. Codes have no cash value.

Free US shipping. Ground shipping within the continental United States is included.

International shipping. Available to Canada, Mexico, Europe, and select Asia-Pacific countries. Shipping fees are calculated based on your region and displayed at checkout. You are responsible for any import duties, VAT, customs fees, or other charges imposed by your destination country.

Shipping address changes. Update your shipping address by emailing orders@qolour.io before the order has shipped. Changes can't be made after shipment.

Risk of loss. Title and risk of loss pass to you on delivery to the carrier (FOB Origin). For lost or damaged shipments in transit, contact us within 14 days of the carrier's delivery scan and we'll work with the carrier to resolve.

Right of withdrawal. You have the right to return your Qubi within 14 days of receiving your order, without giving any reason. To be eligible, the product must be:

• Unused and in the same condition you received it
• In the original packaging
• Accompanied by receipt or proof of purchase

Contact info@qolour.io before returning the product to receive return instructions. Return shipping costs are your responsibility and are non-refundable.

Once we receive and inspect your returned item, we will notify you of the refund status. Approved refunds are processed to your original payment method within 5–10 business days, depending on your card issuer's policies.

If your Qubi arrives defective or damaged, contact us immediately at info@qolour.io. We will arrange return shipping at no cost to you and either issue a full refund or ship a replacement unit. For faulty products, Qolour covers all return shipping costs.

Qolour offers a 1-year limited warranty from the date of delivery against manufacturing defects and hardware failures under normal use.

The warranty does not cover:

• Damage due to improper use or failure to follow product instructions
• Modifications or repairs by unauthorized parties
• Normal wear and tear
• Damage from external causes such as accidents, abuse, drops, water damage, or other events beyond our reasonable control

To make a warranty claim, contact info@qolour.io with your order number and a description of the issue. This limited warranty is in addition to (and does not limit) any rights you may have under applicable consumer protection laws.

Disclaimer. Except for the express limited warranty above, Qolour disclaims all other warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

The Qubi companion app and the Qolour cloud service (which forwards programs to real quantum hardware including Amazon Braket) are licensed, not sold. We grant you a limited, non-exclusive, non-transferable license to use them with your Qubis for personal and educational purposes.

Use of the companion app is also subject to the in-app license and our app privacy policy.

We may modify, suspend, or discontinue cloud features or companion-app features at our discretion. We will give reasonable advance notice for material changes that affect ongoing functionality.

All content on the Site, the Qubi hardware design, the companion app, the Qolour cloud, and the Qolour name and logos are the property of Brightfield Technologies Inc. or its licensors, protected by United States and international intellectual property laws. Nothing in these Terms grants you any right or license except as expressly set out here.

You may not reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Qubi firmware or the Qolour cloud services, except to the extent that applicable law expressly permits despite this limitation.

You agree not to use the Site, the companion app, or the Qolour cloud:

• For any unlawful purpose or in violation of any applicable law
• To send spam, malicious code, or interfere with the operation of our services
• To attempt to gain unauthorized access to other users' accounts or our systems
• To copy, scrape, or otherwise extract content from the Site for commercial purposes without our written permission

The Site, companion app, and Qolour cloud are provided on an “as is” and “as available” basis, except for the express limited warranty in §9.

Limitation of liability. To the maximum extent permitted by law, Brightfield Technologies Inc.'s total cumulative liability to you arising out of or related to these Terms, your order, or your use of the Site, companion app, or Qolour cloud will not exceed the total amount you paid Qolour in the 12 months preceding the event that gave rise to the claim. Qolour will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of business opportunity.

Educational use disclaimer. The Qubi is an educational instrument. It is not certified for medical, life-critical, aerospace, military, or other safety-critical applications, and may not be used as such.

You agree to indemnify, defend, and hold harmless Brightfield Technologies Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your breach of these Terms, your misuse of the Qubi or the Qolour cloud, or your violation of any law or third-party right.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or your order will be resolved in the state or federal courts located in Anne Arundel County, Maryland, and you and Qolour each consent to the personal jurisdiction of those courts.

If you are a consumer in a jurisdiction that grants you mandatory rights to bring a claim in your home country's courts, nothing in this section limits those rights.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. For material changes, we will provide reasonable advance notice (typically by email to customers with active preorders or accounts). Your continued use of the Site or services after a change takes effect constitutes acceptance of the revised Terms.

Entire agreement. These Terms, together with the Privacy Policy and any order confirmations, constitute the entire agreement between you and Qolour regarding your order.

Severability. If any provision of these Terms is held invalid or unenforceable, the rest will remain in full effect.

No waiver. Our failure to enforce any provision doesn't waive our right to enforce it later.

Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
